Welcome to NutriTunes® (“NutriTunes,” “we,” “us,” or “our”). By accessing or using nutritunes.com and our related services (collectively, the “Services”), you agree to be bound by these Terms of Service (the “Terms”). If you do not agree, please do not use the Services.

1) Eligibility & Your Account

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Services. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate, current, and complete information.

2) Health & Medical Content Disclaimer

NutriTunes provides dietary supplements and educational content for general wellness. Information on the Site is not medical advice and is not a substitute for professional diagnosis or treatment. Always consult a qualified healthcare professional regarding any health condition or before starting a new supplement. Products and statements have not been evaluated by the FDA and are not intended to diagnose, treat, cure, or prevent any disease.

3) Products, Availability & Descriptions

Products may be available in limited quantities and are subject to return or exchange only according to our Refund Policy NUTRITUNES. We try to display product information accurately; however, typographical, pricing, or availability errors may occur. We may correct any errors or update information without prior notice.

4) Orders, Pricing & Payment

By placing an order, you authorize us (and our payment processor) to charge your selected payment method for the total amount, including taxes, shipping, and any applicable fees. We may refuse, limit, or cancel quantities at our discretion (e.g., suspected reselling or fraud). If we change or cancel an order, we will attempt to notify you using your account email or phone number.

5) Shipping, Risk of Loss & Title

Shipping times are estimates and not guarantees. Title and risk of loss pass to you upon our transfer of the order to the carrier. Please inspect your delivery on receipt and contact us promptly regarding any issues.

6) Returns & Refunds

Returns and refunds are governed by our Refund Policy (including requirements for unopened condition and prior authorization). Please review it before initiating a return. NUTRITUNES

7) Subscriptions (If Offered)

If you enroll in a subscription, it will auto-renew at the then-current price and frequency until canceled. You can modify or cancel renewals any time before your next billing date via your account or by contacting support. Price changes will be notified in advance where required by law.

8) Promotions, Coupons & Gifts

Promotions are subject to their own terms. Coupon codes are one-time, nontransferable, and may not be combined unless expressly stated. We may modify or end any promotion without notice.

9) SMS/Mobile Messaging Terms

By consenting to receive SMS/text messages from NutriTunes, you agree to recurring automated or manual messages (e.g., order updates, alerts, marketing). Consent is not a condition of purchase. 10) User Content: Reviews, Comments & Submissions

If you submit reviews, comments, photos, or other content (“User Content”), you grant NutriTunes a nonexclusive, royalty-free, worldwide license to use, reproduce, modify, publish, translate, and display such content in connection with the Services and our marketing. You represent that you own or control all rights in your User Content and that it is accurate, lawful, and non-infringing. We may monitor, edit, or remove content we deem objectionable or in violation of these Terms.

11) Acceptable Use

You agree not to:

  • Use the Services for any unlawful purpose or in violation of applicable laws and regulations;

  • Infringe or violate our intellectual property or the rights of others;

  • Upload malicious code, spam, or content that is defamatory, obscene, harassing, or deceptive;

  • Interfere with or circumvent security features;

  • Scrape, crawl, or use automated means to access the Services without permission.

12) Third-Party Services & Links

The Services may include third-party tools or links. We are not responsible for third-party content or practices. Use of third-party services is at your own risk and may be subject to separate terms.

13) Intellectual Property

All Site content (including text, graphics, logos, icons, images, audio/video clips, and software) is owned by NutriTunes or its licensors and protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

14) Disclaimer of Warranties

THE SERVICES AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT UNINTERRUPTED OR ERROR-FREE OPERATION, OR THAT DEFECTS WILL BE CORRECTED.

15) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NUTRITUNES AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES; OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID TO NUTRITUNES FOR THE PRODUCT OR SERVICE GIVING RISE TO THE CLAIM IN THE 12 MONTHS PRECEDING THE EVENT.

Some jurisdictions do not allow the exclusion or limitation of certain damages; the above may not apply to you.

16) Indemnification

You agree to indemnify, defend, and hold harmless NutriTunes and our affiliates, officers, directors, employees, and agents from any claim, demand, loss, or damage (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Services or products; (b) your breach of these Terms; or (c) your violation of any law or third-party rights.

17) Privacy

18) Governing Law & Venue

These Terms and any related disputes are governed by the laws of the State of New Jersey, U.S.A., without regard to conflict of law principles. You consent to the exclusive jurisdiction and venue of the state and federal courts located in New Jersey for any action not subject to arbitration (if applicable under a separate agreement).

19) Changes to the Services or Terms

We may update the Services and these Terms from time to time. If we make material changes, we will post the updated Terms with a new Effective Date. Your continued use of the Services after changes are posted constitutes acceptance.

20) Termination

We may suspend or terminate your access to the Services at any time and for any reason, including if we believe you have violated these Terms. Sections intended to survive termination (e.g., IP, disclaimers, limitations of liability, indemnification, governing law) will continue in effect.

21) Miscellaneous

  • Severability. If any provision is found unenforceable, the remaining provisions will remain in full force.

  • No Waiver. Our failure to enforce any right is not a waiver of it.

  • Assignment. You may not assign your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.

  • Entire Agreement. These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and NutriTunes regarding the Services and supersede prior or contemporaneous understandings.
